ELECTIC LTD

TERMS AND CONDITIONS FOR SMALL ELECTRICAL WORKS

1. Definitions and Interpretation

In these Terms and Conditions:

- “Agreement” means the contract formed when the Customer accepts the Quotation and these Terms.

- “Callout” means any attendance at the Property.

- “Customer” means the person or company ordering the Services.

- “Electic Ltd”, “we”, “us” means Electic Ltd (Company No. 12540284).

- “Final Fee” means the total amount due as shown on the invoice.

- “Property” means the address where the Services are carried out.

- “Quotation” means our written price and scope (valid for 30 days unless stated otherwise).

- “Services” means the electrical callout, EICR, maintenance, repair, fault finding or minor installation work described in the Quotation.

- “Writing” includes email and text message with or without read receipt or delivery confirmation.

Headings are for guidance only. Singular includes plural and vice versa.

2. Quotations and Orders

Orders can be placed by phone, email or text. The Quotation will clearly state the scope, price (fixed or daywork), any deposit, materials required and the expected duration.

The Quotation is based on the information provided. If further issues are discovered on site (especially during an EICR), we will stop and provide a revised Quotation for any additional work. No additional work will proceed without written approval.

3. Deposit and Material Prepayments (if applicable)

- A deposit (normally 25% or a fixed callout fee) may be required and will be shown on the Quotation. It is non-refundable once work has started.

- If high-value materials are needed (e.g. consumer unit, shower, EV charger), we may ask for 100% prepayment of those items with supplier evidence. Prepayments are ring-fenced and deducted from the Final Fee.

4. Payment Terms

Payment terms are clearly stated on every invoice.

- Default terms: Payment is due within 14 days of the invoice date (domestic) or within 30 days of the invoice date (commercial/FM clients), unless a different period is agreed in writing.

- We invoice on completion of the Services (or at the end of each visit for multi-visit jobs).

- For Callouts/EICR where no further work is needed, payment is due immediately on the day of attendance unless a credit account has been agreed.

- Late payments attract interest at 8% above the Bank of England base rate from the due date until paid.

- We reserve the right to suspend or cancel further Services if any invoice is overdue.

- All prices are exclusive of VAT (added at the prevailing rate).

5. Variations and Additional Work

Any extra work, materials or time required due to:

- unforeseen site conditions,

- additional faults found during EICR or maintenance, or

- changes requested by you must be agreed in Writing before we proceed. We will issue a revised Quotation or variation note. Additional work will be charged at the rates shown in the original Quotation or at our standard daywork rates (see Schedule 2) if not specified.

6. Abortive Visits / No-Access Charges

If we attend the Property at the agreed time and cannot carry out the Services because of:

- no access,

- unsafe conditions,

- missing information, or

- customer cancellation with less than 48 hours’ notice, we will charge the full Callout fee or a minimum of 1 hour’s labour plus travel (whichever is greater). This is payable within 7 days.

7. Customer Obligations

You agree to:

- Provide clear, safe access to the Property and the Work Area at the agreed time (or supply keys securely).

- Clear furniture, belongings and obstructions from the Work Area.

- Inform us of any known hazards (asbestos, structural issues, pets, etc.).

- Ensure the electrical supply and any required water/gas isolation is available.

- Obtain any necessary consents (landlord, leaseholder, etc.).

If these obligations are not met and cause delay or extra cost, we may charge additional time and/or cancel the job with the abortive-visit charge applying.

9. Guarantee and Defects

We provide a 12-month workmanship guarantee from the date of completion. We will rectify any defects in our work notified in Writing at no extra cost (excluding damage caused by you, misuse, third-party work or normal wear and tear). Manufacturer warranties on materials still apply separately.

For EICR jobs, the guarantee covers only the remedial works we carried out; the report itself is a snapshot in time.

10. Liability and Insurance

- We carry £5,000,000 public liability insurance.

- Our total liability for any claim is limited to £5,000,000 (except for death/personal injury caused by our negligence).

- We are not liable for indirect losses (e.g. loss of profit, business interruption).

- Title to all materials remains with us until paid in full. Risk passes to you on delivery/installation.

11. Health & Safety

We comply with all relevant health & safety legislation. If the site becomes unsafe or we discover hazards you did not disclose, we may suspend work immediately without liability and charge for time already spent plus any abortive costs.

12. Data Protection and Confidentiality

We process your personal data in accordance with UK GDPR. Our Privacy Policy is available on request. Both parties will keep any confidential information secure and not disclose it except as necessary to perform the Services or as required by law.

13. Force Majeure

Neither party is liable for delays caused by events beyond reasonable control (e.g. severe weather, strikes, supply shortages). If the delay exceeds 14 days either party may cancel with a fair payment for work already completed.

14. Termination

We may terminate immediately if:

- you fail to pay any invoice by its due date, or

- you commit a material breach that is not remedied within 7 days.

On termination all outstanding sums become immediately due.

15. General

- These Terms form the entire agreement and can only be varied in Writing.

- If any clause is found invalid, the rest remain in force.

- No waiver of any right is a waiver of future rights.

- You may not assign the contract without our written consent.

- Notices must be in Writing and are deemed received when delivered by hand/email (with receipt) or 2 Business Days after posting.

16. Governing Law

These Terms are governed by the laws of England and Wales. Disputes will first be negotiated; if unresolved they will be dealt with in the courts of England and Wales.

- Electrician (standard hours): £42 per hour (or part thereof)
